Carol P. Keough is the owner with the Keough Law Firm, PLLC.  She is a twenty-seven year practicing attorney with offices in the Houston and the Galleria area primarily working as a consultant and legal representative to her business and corporate clients on matters related to Labor and Employment, Employment and Business contracts and Commercial Litigation.  She can be reached by phone at 713.239.5617 and by email at carol@keoughlawfirm.com.

Carol is Board Certified in Labor and Employment Law and specializes in representing employers in all areas of labor and employment law.  She provides consultation, practical resolutions of employee issues and successful representation of corporate clients before administrative agencies, such as OSHA, the Department of Labor, the Department of Justice, the Equal Employment Opportunity Commission (EEOC), the Texas Workforce Commission (TWC), state and federal district courts.

Her goal is to help her clients avoid litigation by initiating a strong proactive approach to each employment issue.  The areas set out below emphasize her broad experience:

  • Defended cases alleging discrimination, retaliation, harassment, including cases with class and collective allegations.
  • Sarbanes-Oxley Whistleblower claims.
  • Coordinated, conducted, and assisted with the resolutions of numerous confidential investigations involving alleged executive misconduct, investigations into claims of sexual harassment, sexual assault, company-wide discrimination, fraud and federal criminal immigration hiring and harboring allegations.

In addition, Carol has twenty-seven years of reaching favorable economic resolutions for business clients in all aspects of commercial and contract law. She analyzes insurance policies and coverage issues to assist her clients in managing risks and potential liability. She is well versed in handling  DTPA, and Prompt Payment Statute claims and lien claims.

She consults regularly on risk management issues for commercial businesses municipalities and handles any insurance coverage issues for them. She has victoriously handled insurance litigation for the benefit of her business clients to protect their rights in both insurance and indemnity contracts. She has successfully written appeals and argued before the Texas Supreme Court, many Texas courts of appeals, the U.S. Court of Appeals for the 5th Circuit.

The areas below demonstrate her broad experience:

  • Handled complex litigation for commercial clients on issues of enforcement of Non-Compete, Non-Disclosure Agreements, contractual liability, enforcing contracts  and indemnity agreements.
  • Defended clients on all issues related to Employment Law  including FMLA, FLSA, Title VII,  ADA, Equal Pay Act and Texas State law employment claims under Chapter 21 of the Labor Code, TWC unemployment, wage and Pay Day Act issues and workers compensation.
  • Defended clients on OSHA claims and claims for retaliation under OSHA.
  • Defended breach of contract and all aspects of business law claims related to partners, members and shareholders.
  • First-chaired numerous trials in both state and federal court.
  • Handled lien claims related to construction projects.
  • Handled all aspects of business formation under the Texas Business Organizations Code  and operation agreements, bylaws, shareholder agreements and succession planning in your agreements.
  • Handled all aspects of creation and update for employee handbooks, protecting trade secrets with Confidentiality, Non-Disclosure, Non-Solicitation and Non-Compete Agreements.
  • Advised clients on investigations regarding sexual harassment, other harassment, employee theft and terminations.
  • Advised and handled all aspects of investigations and penalties with Texas Health and Human Services on behalf of caregiver agencies and providers for elder and disabled care.

One of Carol’s passions is assisting parents of disabled adults because of her own daughter’s disabilities.  Carol provides valuable information about getting services for the disabled from her own personal experiences.  One of the legal services she offers is to set up guardianship.

Carol is a grandmother of twins, with a new grandchild due in November 2019.  She spends time gardening, walking and running with her dogs and she is an avid reader.

Speaking Background

Carol also provides legal education and supervisor/employee training to corporate clients, business owners, and various business/trade organizations in public and private events.  Carol has been providing legal education on contracts and employment issues at the University of Houston’s Small Business Development Center for more than 5 years.  In 2019, the two most highly requested and attended series for her speeches were the Employment Law Series and the very popular Business Contract Series.  The Association of Business and Professional Women were very interested in Cybersecurity Law in this current age of the many online threats to their businesses.  The Clear Lake Chamber with SBDC San Jacinto sponsored “Creating Enforceable Contracts” in August 2019.  Another popular presentation for SBDC San Jacinto with the Pearland Chamber was “Social Media Law”.
